Section 128 Governor Checks

All Hillingdon schools are aware of the current statutory guidance Keeping Children Safe in Education (KCSIE).

Hillingdon Council requires maintained schools to undertake a section 128 check for all their governors. Local authority governors have a section 128 check through the Council. This is a non-statutory check, however recommended within KCSIE as critical to Safeguarding (para 260 and 315, 2022). Academy schools must undertake a section 128 check for all new governors / trustees.

Section 128 checks see whether a person is banned from being involved in the management and governance of schools. If someone has been issued with a section 128 direction, they cannot serve on the Governing Board, and in academies it also means they cannot be on the senior management team. This will highlight a governor's history that may not be criminal, therefore not picked up through the Enhanced DBS process.

Enhanced DBS for all governors is also required within 21 days of appointment. The Local authority recommends (non-statutory) that an Enhanced DBS is reviewed every four years (every governor's full term) to access updated information on a regular basis.

Governors are not usually engaged in Regulated Activity with Children, therefore, a check against the Children's Barred List will not be included as part of their Enhanced DBS check. However, if you believe a governor needs to engage in Regulated Activity, then please contact the DBS for specific guidance.

In order to undertake a section 128 direction check, please use the Teaching Regulation Agency by firstly logging in to your DfE account DfE Sign-in.
